Terms of Use

These terms govern the use of the Kunduzo application and web pages provided by HİPOPOTAMYA BİLİŞİM LTD. ŞTİ. (Değirmiçem Mah. Nail Bilen Cad. Uğur Plaza No:5/149 Şehitkamil/Gaziantep, Türkiye). By opening an account you accept these terms.

1. What the service is

Kunduzo is a flight logbook, flying site information and community application for paragliding pilots and clubs. It lets you keep a flight logbook, analyse your flight tracks, see information and weather forecasts for flying sites, and follow your club membership and events.

1.1 This application is not a flight instrument

Kunduzo is not designed to be used during flight. It is not a navigation tool, variometer, airspace warning system or any other flight instrument, and it does not replace them. It is an information tool for before and after flight; do not base your flight decision on the application.

2. Your account

  • Only people aged 18 or over may use the service. You declare this when you open an account, and you are responsible for the accuracy of that declaration.
  • A valid email address is required to open an account; you can also sign in with your Google or Apple account.
  • You are responsible for the accuracy of the information you give. You enter your licence, endorsement and insurance details yourself; Kunduzo does not verify them, and a record in the application does not replace a certificate of competence.
  • You are responsible for the security of your account and password. If you notice any unauthorised use, tell us immediately.
  • You can delete your account at any time from within the application; the deletion takes place at the end of a 7-day waiting period.

3. User content and licence

The IGC files, photos, posts, comments, site information and reviews you upload belong to you.

By uploading this content you grant HİPOPOTAMYA BİLİŞİM LTD. ŞTİ., solely for the purpose of providing the service, a free, non-exclusive and worldwide licence to store, reproduce, process and display the content and to pass it to other users according to the visibility setting you choose.

When you delete your content, it is no longer shown to other users and this licence ends as regards displaying it in the service; the record itself is kept until your account is deleted. The following content is an exception to this rule and also remains in the service, with the link to you removed, when you delete your account:

  • Flying site records, edits, site alerts and site photos. These are information about the flying site rather than about you, and they benefit everyone who uses that site.
  • Club announcements and events you created. These are the club's records.

You declare that you hold the necessary rights to the content you upload. Do not upload someone else's photo or copyright-protected content without permission.

4. Sharing flight records

  • You choose who can see each flight: public, followers, club or only you.
  • A flight you make public can be viewed without signing in, through a web link and a share image. Anyone who receives that link can see the flight. When you make the flight non-public or delete it, the link and the image stop working.
  • Your public flights are shown to everyone, and your club flights to your club mates, in the take-off site's "who flew here today" list, and they are counted in the site statistics. If one of your public flights is the site's duration or distance record, it is shown with your name.
  • You appear with your name in your club's and league's rankings; the ranking of a closed period is frozen and does not change.
  • Your flight intent ("I'm going flying today") is shown, with the visibility you choose, to users who want to know who is going to that site that day.
  • An IGC file is a complete location record. Check your visibility setting before sharing.
  • Do not upload a flight record belonging to someone else as your own flight.

5. Prohibited conduct

You agree not to:

  • Act on behalf of, or impersonate, another person, club or organisation;
  • Share content containing harassment, hate speech, threats, insults or discrimination;
  • Share obscene or violent content;
  • Spread false information that endangers flight safety (e.g. an untrue site alert or a made-up weather report);
  • Upload someone else's flight data or personal data without permission;
  • Alter flight data to gain an advantage in rankings;
  • Overload the service with automated tools, scrape data, try to circumvent security measures or try to access someone else's account;
  • Use safety contact invitations or landing alerts to harass anyone;
  • Use the application for any purpose contrary to the legislation in force.

6. Moderation, blocking and reporting

  • You can block other users and report content. Blocking works both ways and is not notified to the other person.
  • We reserve the right to remove content that breaches these terms, issue a warning, restrict, suspend or close an account. You are notified of the decision and its reason.
  • To appeal a moderation decision, write to info@hipopotamya.com.
  • Moderation decisions are recorded together with their reasons.

7. Clubs and club officers

  • Club officers are themselves responsible for the content of the announcements and events they share in the club and for using their members' data only for club management.
  • A club officer can see members' licence level and issuing body, IPPI level, instructor grade and endorsement, IPPI, insurance, medical certificate and wing check dates, and can verify the licence. They cannot see members' licence, IPPI and policy numbers, blood type, allergy information or emergency contact.
  • The owner of a club must transfer the club to another member before deleting their account.
  • HİPOPOTAMYA BİLİŞİM LTD. ŞTİ. is not a party to membership fee, training or membership relationships between clubs and their members or to disputes arising from them.

8. Flight safety and responsibility

The flight decision and the responsibility for it rest entirely with the pilot.

  • Paragliding is a risky sport. No information shown in the application means that it is safe to fly.
  • Weather information is for information only. Forecast data comes from a third-party provider, is not an aviation forecast and does not guarantee the weather conditions that will occur. The airport observation is a measurement at the nearest airport, not at the flying site. The flyability assessment is an automated calculation; it is not a flight permit or a recommendation.
  • Weather summaries generated with artificial intelligence can be wrong. These texts are generated automatically from forecast data and are not an expert opinion.
  • Flying site information is entered by users. Take-off and landing places, directions, hazards and alerts are community contributions; they are not guaranteed to be current, accurate or complete. Responsibility for permission to use the site, its ownership and its local rules rests with you.
  • Before flying, check official weather forecasts, NOTAMs and airspace restrictions yourself, assess the site and your equipment yourself, and comply with the aviation legislation in force and your licence and insurance obligations.

9. Limits of the safety features

"Landed safely" is not a search, rescue or emergency assistance service.

  • If you have not said "landed" 15 minutes after your expected landing time, the landing timer sends you a reminder. If you still have not responded 15 minutes later, it passes the alert only to people who use the application and have accepted to be your safety contacts and, if you chose so for that timer, to your club's officers.
  • The application does not call 112 or any emergency service, sends no SMS to anyone and does not reach the emergency contact on your pilot card.
  • The alert does not contain your location; it contains only the name of the site you chose, your expected landing time and the note you wrote.
  • The alert is written to the notifications screen in the recipient's application. On the effective date of these terms no push notifications are sent to phones; the recipient sees the alert when they open the application.
  • Delivery of the alert depends on the recipients' phones being switched on and connected to the internet, on them opening the application and on the service running without interruption. There is no guarantee that the alert will arrive, be read or that anyone will act on it.
  • Your safety contacts take on no obligation towards the alert; the arrangement between you and them is yours.
  • The pre-flight checklist and equipment maintenance reminders are aids; they do not replace the equipment manufacturer's instructions or authorised maintenance and inspection obligations.
  • The blood type, allergy and emergency contact information on your pilot card is visible only on your phone, when you show it. You are responsible for its accuracy and currency.

If you are in danger, or believe someone is in danger, call the 112 Emergency Call Centre.

10. Limitation of liability

The service is provided "as is". To the extent permitted by the legislation in force, HİPOPOTAMYA BİLİŞİM LTD. ŞTİ. does not undertake that the service will be uninterrupted or error-free or that flight analyses, statistics, weather information or site information will be accurate.

To the extent permitted by the legislation in force, HİPOPOTAMYA BİLİŞİM LTD. ŞTİ. is not liable for indirect damage, loss of profit or loss of data arising from the use of, or inability to use, the application.

This limitation does not cover the consequences of intent and gross negligence, liability for death and personal injury, or non-waivable rights arising from consumer legislation. Subject to these exceptions, the total liability of HİPOPOTAMYA BİLİŞİM LTD. ŞTİ. arising from these terms is limited to the total amount you paid for the service in the twelve months before the event giving rise to the damage or, if you paid nothing, to TRY 1,000.

We recommend that you regularly take your own backup with the account export feature to protect against loss of your data.

11. Pricing

Kunduzo is free of charge. If paid features are offered in the future, prices and terms will be announced in advance. No fee is charged without your explicit approval.

12. Changes to and discontinuation of the service

  • We may develop the service, change or remove features. Significant changes are announced in advance.
  • If we discontinue the service entirely, notice is given at least 90 days in advance so that you can download your data.
  • In the event of a serious or repeated breach of these terms, we may suspend or close your account.

13. Changes to these terms

When the terms are updated, a new version is published and shown when you open the application. A published version is never changed afterwards. If you do not accept the change, you can delete your account.

14. Your personal data

The processing of your personal data is explained in the Privacy Notice and the Privacy Policy. Separate texts are shown for processing that requires explicit consent; those consents do not depend on accepting these terms.

15. Governing law and jurisdiction

These terms are governed by the law of the Republic of Türkiye. The courts and enforcement offices of Gaziantep have jurisdiction over disputes.

If you use the service as a consumer, your right to apply, within the monetary limits in force, to the consumer arbitration committees and consumer courts of your place of residence or of the place where the transaction was made is reserved.
